Terms & Conditions
Last updated: July 4, 2026
These Terms govern access to the SpecterHawk website and public-facing materials. They do not replace any executed agreement, procurement document, statement of work, security addendum, data processing addendum, government clause, or public-sector requirement that applies to a specific engagement.
1. Acceptance and Authority
By accessing or using this website, you agree to these Terms. If you access the website on behalf of an organization, agency, command, institution, or enterprise, you represent that you are authorized to do so and that your use is consistent with applicable internal policies and law.
2. Informational Scope
The website is provided for informational, evaluation, and business-development purposes. It does not provide operational command, legal advice, procurement approval, security clearance, authorization to operate, classified capability, financial advice, or mission authorization.
Public website materials may describe concepts, architectures, domains, planned capabilities, or examples. They do not create warranties, delivery obligations, certification status, compliance status, or operational commitments.
3. Separate Written Agreements
Any deployment, pilot, integration, assessment, data exchange, production use, government procurement, enterprise procurement, security review, data processing, or operational engagement must be governed by a separate written agreement. If there is a conflict between these Terms and an executed agreement, the executed agreement controls for that engagement.
4. Government and Regulated-Industry Use
Public-sector, defense, intelligence, critical-infrastructure, regulated-industry, and enterprise users remain responsible for compliance with applicable procurement rules, security requirements, data-handling instructions, information classification rules, records obligations, sovereign-immunity rules, and mandatory clauses that cannot be waived by website terms.
Nothing in these Terms waives non-waivable government rights, statutory rights, audit rights, public-record obligations, procurement-integrity obligations, or mandatory local-law requirements.
5. Restricted Information
Do not submit classified information, controlled unclassified information, export-controlled technical data, protected health information, credentials, operational secrets, sensitive personal information, vulnerability details, source-selection information, procurement-sensitive material, or confidential third-party material through public website channels unless SpecterHawk has expressly approved the channel and handling procedure in writing.
6. Permitted Use
You may use the website only for lawful purposes and in a manner that does not impair, disrupt, interfere with, or attempt to gain unauthorized access to the website, infrastructure, users, or related systems.
- Do not probe, scan, test, attack, overload, bypass, reverse engineer, or attempt to circumvent security controls except through a written authorization or approved vulnerability disclosure channel.
- Do not scrape, harvest, mirror, bulk extract, train models on, or republish website content without written permission.
- Do not misrepresent affiliation with SpecterHawk or make unauthorized statements about SpecterHawk capabilities, certification, accreditation, customer relationships, or government status.
- Do not submit unlawful, infringing, malicious, deceptive, export-restricted, or harmful material.
7. Intellectual Property
The website, including text, graphics, interfaces, images, logos, marks, software, documentation, and other materials, is owned by or licensed to SpecterHawk and is protected by intellectual-property and unfair-competition laws. Except as expressly permitted by law or written agreement, you may not copy, modify, distribute, reverse engineer, frame, or create derivative works from the website or its materials.
8. Feedback
If you provide suggestions, ideas, comments, or feedback, you grant SpecterHawk a non-exclusive, worldwide, irrevocable, royalty-free right to use that feedback without restriction or obligation to you. Do not provide feedback that is confidential, restricted, procurement-sensitive, export-controlled, or not authorized for disclosure.
9. Third-Party Services and Links
The website may reference third-party websites, data sources, standards, frameworks, tools, or services. SpecterHawk does not control and is not responsible for third-party content, availability, security, terms, privacy practices, or compliance status.
10. Security Monitoring
SpecterHawk may monitor, log, restrict, suspend, or block activity to protect the website, users, customers, and systems. Monitoring may include automated and manual review of traffic, access events, abuse indicators, technical metadata, and suspected misuse. Security monitoring is described further in the Privacy Policy and Data Protection / Enterprise Data Notice.
11. Export, Sanctions, and Restricted Uses
You are responsible for complying with all applicable export-control, sanctions, anti-boycott, anti-corruption, procurement-integrity, and restricted-party laws. You may not use the website where prohibited by law, in support of unlawful activity, or to request activity involving prohibited jurisdictions, sanctioned parties, restricted end uses, or restricted end users. Additional terms appear in the Export & Sanctions Notice.
12. Procurement and Public-Sector Communications
Website materials are not a bid, offer, proposal, quotation, representation of current eligibility, or commitment to accept any public-sector term unless expressly stated in a signed writing. Additional terms appear in the Procurement / Government Use Notice.
13. Privacy and Data Protection
Personal information and website-level data are handled according to the Privacy Policy. Enterprise, government, customer, partner, controlled, classified, sensitive, or deployment data must be governed by the applicable written agreement and security documentation.
14. International and Mandatory Legal Requirements
These Terms are intended to operate alongside applicable privacy, export-control, sanctions, anti-corruption, public-procurement, consumer-protection, accessibility, records, cybersecurity, and government-use laws. Nothing in these Terms limits rights, remedies, obligations, disclosures, audit rights, public-sector requirements, or statutory protections that cannot legally be limited by website terms.
If a mandatory law, court order, regulator instruction, government clause, procurement rule, or signed written agreement conflicts with these Terms, the higher-priority requirement controls for the affected use.
15. Disclaimers
The website is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, SpecterHawk disclaims all warranties, express or implied, including warranties of accuracy, availability, fitness for a particular purpose, merchantability, non-infringement, uninterrupted operation, security, and error-free operation.
Public website materials do not guarantee availability, certification, accreditation, authorization to operate, regulatory approval, export classification, security status, performance, suitability, future delivery, or mission suitability.
16. Limitation of Liability
To the maximum extent permitted by law, SpecterHawk will not be liable for indirect, incidental, consequential, special, exemplary, punitive, loss-of-profit, loss-of-revenue, loss-of-data, business-interruption, procurement, operational, national-security, or mission-impact damages arising from or related to the website.
17. Indemnity
Where permitted by applicable law, you agree to defend, indemnify, and hold SpecterHawk harmless from claims, damages, liabilities, costs, and expenses arising from your misuse of the website, violation of these Terms, submission of material you were not authorized to provide, or violation of applicable law.
18. Changes
SpecterHawk may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Continued use of the website after an update means you accept the updated Terms.
19. Governing Law and Conflicts
Unless a separate written agreement states otherwise, governing law, forum, and dispute procedures will be determined by the applicable mandatory law, procurement rule, or written agreement covering the relationship. If mandatory law gives you non-waivable rights, those rights are not limited by these Terms.
